Randall H. Scarlett Secures $9.4 Million Verdict for Clients Who Lost Loved Ones in Crash

The award was part of an overall verdict of more than $18 million that was given to two sets of plaintiffs.

The lawsuit at issue was entitled Jones, et. al. v. Bhandal Brothers Trucking, Inc., and the State of California, Department of Transportation (Caltrans). It was filed the Monterey County Superior Court and it was assigned a case number of M111007/M 114050. The case was a wrongful death action that was filed after two people were killed in a car accident that occurred on November 5, 2010 within the boundaries of Monterey County.

Mr. Scarlett represented the surviving family members of a 48-year-old woman. According to court documents, the woman was driving on Highway 156 but stopped in order to turn left into her private driveway. As the woman was waiting to turn, she was allegedly hit from behind by a big-rig truck. The court documents stated that as a result of this collision, both vehicles veered into the path of an oncoming vehicle. The second crash allegedly caused the deaths of the woman and of a four-year-old boy who was a passenger in that oncoming vehicle.

Two lawsuits were filed on behalf of each of the people who were killed in this accident, and they were consolidated. After hearing arguments and considering evidence that was presented at trial, the jury returned a verdict of $18,681,052. $9,406,186.53 of the total award was given to Mr. Scarlett's clients. According to court documents, the jury found that Caltrans was 60 percent at fault for the crash due to the failure of the state to repair a highway that was operating beyond capacity. The jury further found the trucking company that employed the big-rig driver to be 40 percent at fault for the accident.
